AI and Medical Whistleblowing: Legal and Ethical Dimensions

| Abstract | The integration of Artificial Intelligence (AI) into healthcare has transformed patient care, diagnostics, and hospital administration. However, the same AI systems introduce novel challenges regarding accountability, data privacy, and ethical obligations, particularly for medical professionals who expose malpractice or systemic failures. Medical whistleblowing, traditionally protected under legal frameworks to ensure patient safety, now intersects with AI-driven clinical decision-making, predictive algorithms, and automated monitoring systems. This paper examines the legal and ethical implications of AI in the context of medical whistleblowing, evaluating how existing whistleblower protections may need to evolve to address AI-induced complexities. Drawing upon comparative legal perspectives, case studies, and international guidelines, the paper proposes a framework to harmonize AI integration in healthcare with robust whistleblower safeguards. |
