Role Of Environmental Law In Governing Nanotechnology Applications

Abstract Over the past two decades, nanotechnology has moved from laboratory research to widespread commercial application. Governments across the world, including India, the United States, and member states of the European Union, have invested heavily in nanoscale research due to its potential to enhance industrial efficiency, healthcare delivery, environmental protection, and energy sustainability. Nanomaterials are now present in everyday products such as cosmetics, textiles, food packaging, medical devices, and water purification systems.

Despite this rapid expansion, regulatory development has not progressed at the same pace. Environmental laws were largely drafted before nanotechnology became commercially viable and therefore do not specifically address nanoscale materials. Scientific understanding of long-term nanoparticle toxicity, environmental persistence, and bioaccumulation is still evolving, creating uncertainty for policymakers. This gap between technological advancement and regulatory preparedness forms the foundation of the present research. The study emerges from the need to examine whether existing environmental legal frameworks are capable of effectively governing nanotechnology applications or whether targeted reforms are required.
