| Abstract | This paper critically examines the process and institutional challenges affecting the effective implementation of avoidance transaction provisions under the Insolvency and Bankruptcy Code, 2016, despite their vital role in preserving the corporate debtor's estate and protecting creditor interests. It analyses the evolving judicial approach, the role of Resolution Professionals and forensic audits, and proposes reforms to strengthen avoidance jurisprudence through improved evidentiary standards, technological integration, and institutional capacity. |
