Role of Human Rights during Covid -19 in Special Reference to Right to Health

Abstract	The COVID-19 pandemic was not only a global public health emergency but also a significant human rights challenge, particularly concerning the realization of the right to health. This research critically examines the role of human rights during the COVID-19 pandemic, with particular reference to the right to health. The study analyses the impact of the pandemic on healthcare access, the disproportionate effects on vulnerable and marginalized populations, and the measures adopted by governments to protect health rights. It also examines the legal obligations of states under international human rights standards and the Indian constitutional framework, particularly the interpretation of the right to health as an integral part of the right to life under Article 21 of the Constitution of India. The research adopts a doctrinal methodology based on the study of legal frameworks, international treaties, statutes, judicial decisions and relevant literature. It further examines the role of international organizations, including the World Health Organization, and civil society organizations in promoting equitable healthcare access and protecting human rights during the pandemic. The study finds that COVID-19 exposed significant inequalities in healthcare systems and disproportionately affected vulnerable populations. It emphasizes that public health measures must be implemented in accordance with the principles of equality, non-discrimination, transparency, accountability and human dignity. The study concludes that a human rights-based approach is essential for effective pandemic preparedness and response. Strengthening healthcare infrastructure, ensuring equitable access to healthcare resources, protecting vulnerable groups, promoting transparency and accountability, and enhancing international cooperation are necessary to protect the right to health during future health emergencies.
