Assessing the Legal Challenges of Artificial Intelligence Use in Children’s Education in Tanzania

Author(s) Ms. Winfrida Emanuel Mroso
Country Tanzania
Abstract This article examines the legal challenges related to the use of artificial intelligence in children’s education in Tanzania. It asks whether the existing legal framework protects children from risks arising from AI use in the learning process. The article invokes doctrinal methodology, while analysing the legal framework, international and regional instruments and scholarly literature relevant to the study. It finds that, although Tanzania has enacted laws on child protection, education and personal data protection and a National Guidelines for Artificial Intelligence in Education (2025), the law remains far from addressing AI-specific risks affecting children in education, which include personal data protection, consent, automated decision-making, algorithmic bias, transparency and accountability. The article recommends the adoption of clear, child-centred regulatory standards for AI use in education, supported by oversight and accountability mechanisms. It concludes that Tanzania’s emerging AI governance framework must expressly address children’s rights and educational contexts.
